سپریم کورٹ کے چیف جسٹس عمر عطا بندیال نے ریمارکس دیتے ہوئے کہا ہے کہ نیب ترامیم اس اسمبلی نےکیں جو مکمل ہی نہیں، اس نکتے پر کوئی قانون نہیں ملا کہ نامکمل اسمبلی قانون سازی کر سکتی ہے یا نہیں۔سپریم کورٹ میں نیب ترامیم کے خلاف عمران خان کی درخواست پر سماعت ہوئی ہے۔چیف جسٹس عمر عطا بندیال نے کہا کہ سیاسی حکمت عملی کے باعث آدھی سے زیادہ اسمبلی نے بائیکاٹ کر رکھا ہے۔عمران خان کے وکیل خواجہ حارث نے دلائل دیتے ہوئے کہا کہ ایگزیکٹو اپنا کام نہ کرے تو لوگ عدالتوں کے پاس ہی آتے ہیںجسٹس اعجاز الاحسن نے ریمارکس دیتے ہوئے کہا کہ نیب ترامیم سے فائدہ صرف ترمیم کرنے والوں کو ہی ہوا ہے، چند افراد کی دی گئی لائن پر پوری سیاسی پارٹی چل رہی ہوتی ہے۔انہوں نے کہا کہ لائن فالو کرنے سے فائدہ صرف چند افراد کی ذات کو پہنچتا ہے، نیب ترمیم کی ہدایت کرنے والوں کو اصل میں فائدہ پہنچا، کیا ایسی صورتحال میں عدلیہ ہاتھ پیر باندھ کر تماشا دیکھے؟جسٹس اعجازالاحسن کا کہنا ہے کہ نیب ترامیم کو بغیر بحث جلد بازی میں منظور کیا گیا، ترامیم کی نیت ہی ٹھیک نہ ہو تو آگے کچھ اور جاننے کی ضرورت ہی نہیںسپریم کورٹ کے چیف جسٹس نے ریمارکس دیتے ہوئے کہا کہ عدالتی فیصلوں کے باوجود کرپشن ختم نہیں ہو سکی، مسئلہ صرف کرپشن کا نہیں سسٹم میں موجود خامیوں کا بھی ہے، سسٹم میں موجود خامیاں کبھی دور کرنے کی کوشش نہیں کی گئی۔چیف جسٹس عمر عطا بندیال نے کہا کہ پارلیمان کا کام ہے سسٹم میں بہتری کے لیے قانون بنائے اور عمل بھی کرائے، صوبے میں 5 ماہ بعد آئی جی اور 3 ماہ بعد ایس ایچ او بدل جاتا ہے، ایگزیکٹو فیصلے کرتے وقت قانون پر عمل نہیں کیا جاتاانہوں نے کہا کہ ماضی میں ریکوڈک اور اسٹیل مل کے فیصلے عدالت نے اچھی نیت سے کیے، حکومت سسٹم کی کمزوری کے باعث منصوبوں میں کرپشن پکڑ نہیں سکی، نیب قانون کے غلط استعمال سے کتنے لوگوں کے کاروبار تباہ ہو چکے ہیں، کرپشن پر کسی صورت معافی نہیں ہونی چاہیے۔جسٹس منصور علی شاہ نے کہا کہ کرپشن غلط ہے اور اس میں کوئی شک نہیں کہ کرپشن ہونی نہیں چاہیے، سوال یہ ہے کرپشن کا سدباب کسے اور کیسے کرنا ہے؟عمران خان کے وکیل خواجہ حارث نے کہا کہ کرپشن ختم کرنا ایگزیکٹو کا کام ہے، اگر ایگزیکٹو اپنا کام نہیں کر سکی تو عدالت مداخلت کرتی ہے، عدالت نے ہمیشہ عوامی عہدوں پر کرپشن کرنے والوں کے خلاف کارروائی کی ہےچیف جسٹس عمر عطا بندیال نے استفسار کیا کہ کیا پھر ہم حالیہ نیب ترامیم کو ’پارلیمنٹری کیپچر‘ کہیں گے؟عمران خان کے وکیل نے چیف جسٹس کو جواب دیتے ہوئے کہاکہ پارلیمنٹری کیپچر کسی اور معنیٰ میں استعمال ہوتا ہے۔عمران خان کے وکیل خواجہ حارث نے کہا کہ نیب قانون کا اطلاق افواج پاکستان پر نہیں ہوتا، فورسز کے ان افسران پر نیب قانون لاگو ہوتا ہے جو کسی سول ادارے میں تعینات ہوں، نیب قانون کا اطلاق عدلیہ پر بھی نہیں ہوتاجسٹس منصور علی شاہ نے کہا کہ نیب قانون کے مطابق آرمی افسران ریٹائرمنٹ کے بعد بھی عہدہ لیں تب بھی سوال نہیں ہو سکتا، عدالت کو اس سوال پر اپنے دلائل دیں۔سپریم کورٹ نے کیس کی مزید سماعت کل تک ملتوی کر دی، عمران خان کے وکیل خواجہ حارث عدالتی سوالات کے جواب دیں گے
